Types of FMLA Leave

Intermittent FMLA Leave

Intermittent FMLA leave allows an employee to take leave from work in separate blocks of time, rather than all at once, for qualifying medical reasons (up to 60 working days or 480 hours in a 12 month period). Intermittent leave is typically used when an employee needs smaller, unpredictable increments, such as:

  • Medical appointments (e.g., for chronic conditions or treatments)
  • Flare-ups of a serious health condition (e.g., periodic migraines, asthma attacks, or mental health episodes)
  • Absences due to a family member’s illness (e.g., caring for a child or spouse with a serious condition)

This type of leave can be taken in hourly, daily, or weekly intervals depending on the situation and the employer’s policies. The employee should notify the employer in advance and may be required to provide medical certification to justify the need for intermittent leave.

Continuous FMLA Leave

Continuous FMLA leave refers to taking time off from work in a single, uninterrupted block, typically for a more significant or prolonged health condition. Under the Family and Medical Leave Act (FMLA), an employee can use up to 12 consecutive weeks of leave when they need to be off work for an extended period, such as:

  • Recovery from surgery or hospitalization
  • Extended illness or injury (e.g., cancer treatment, severe mental health episodes, or long-term physical conditions)
  • Childbirth or adoption (e.g., taking leave for the birth of a child or to care for a newborn)
  • Caring for a family member with a serious health condition that requires ongoing care

In contrast to intermittent FMLA leave, which is taken in smaller increments, continuous leave is generally used for situations where the employee is unable to work for a longer periods of time, such as several days, several weeks, or months.
